Welcome to the website of the Or Ben Avi law office at BenAvi-Law.com, including its sub-domains (the “Site”), operated by Or Ben Avi, Law Office (the “Operator”).

The Site presents information about the Operator, its activity and/or its services, and is intended for visitors who are interested in them.

1. Consent to the Terms of Use

Use of the Site, including the content displayed on it and the services offered on it, is subject to the following Terms of Use. In these terms, “Content” includes, among other things, information, offers, recommendations and details of any kind, including any textual or visual content, software, file, database and interface, as well as any character, mark, symbol and icon. Please read these terms carefully, as entering and using the Site and its Content indicate your consent to and acceptance of these Terms of Use, including consent to the Operator’s Privacy Policy. If you do not agree to the Terms of Use, in whole or in part, you may not use the Site for any purpose. You may use the Site and the Content included in it only in accordance with the rules set out below. The Operator reserves the right to update the Terms of Use from time to time. These terms apply to use of the Site and its Content through any computer or other communication device, including a mobile phone and a tablet.

Use of the Site is intended for adults over the age of 18 only. Your use of the Site constitutes confirmation that you are at least 18 years old.

2. Users’ undertakings

The Operator wishes to ensure that the Site is run in an orderly and proper manner and that the various content published on it serves its users in the best and safest way. Therefore, in using the Site, you are required not to carry out any of the following actions:

2.1 Impersonating any person or entity and/or uploading or transmitting any false or misleading material.

2.2 Altering, adapting, copying, scraping, disassembling or reassembling any component of the Site.

2.3 Distributing “junk mail” (spam) or flooding the Site’s servers with any other mail.

2.4 Uploading or transmitting any material containing any kind of virus or computer code intended to destroy, interfere with or restrict the use of any of the computers, servers, hardware and software used by the Operator to operate the Site. In addition, you may not operate, or allow the operation of, any computer application or any other means, including software such as crawlers, robots and the like, for the automated searching, scanning, copying or retrieval of content from the Site, except for search engines and tools that index the Site in order to display it in search results. This includes not creating or using such means to create a compilation, collection or database containing content from the Site.

2.5 Infringing in any way copyright, trademarks or any other proprietary right in the Site, including making any commercial use of the Site without the Operator’s prior written consent.

2.6 Placing the Site or any part of it within a frame of another website, or as part (a mirror) of another website, without the Operator’s prior written approval.

2.7 Interfering in any way with the operation of the Site.

2.8 Collecting information about users of the Site, or selling, distributing and/or making commercial use of information on the Site, or any other use in a manner that may harm another person.

2.9 Linking to the Site from a website containing pornographic content, content that encourages racism or unlawful discrimination, content that is contrary to the law or whose publication is contrary to the law, or content that encourages unlawful activity.

The Operator will bear no liability for any damage caused as a result of any link to content from the Site or of any display, upload or publication of such content in any other way. You bear full and sole responsibility for any link to, or display or publication of, the content, and undertake to indemnify the Operator for any damage caused as a result. These provisions do not derogate from any other provision of the Terms of Use.

3. Privacy Policy

The Operator respects the privacy of the Site’s visitors. Information you provide in the course of using the Site and/or the services is collected, handled and stored in accordance with the Operator’s Privacy Policy, available at BenAvi-Law.com/en/privacy (the “Privacy Policy”). The Privacy Policy forms an integral part of the Terms of Use; please read it carefully.

4. No representations

4.1 Your use of the Site and of the content on it, and your reliance on them, are at your sole responsibility. The Site, the services and the content on it are provided as is (AS IS) and as available (AS AVAILABLE), and you will have no claim, suit or demand against the Operator and/or anyone on its behalf in respect of the Site’s features, the content, the correctness, completeness, currency and accuracy of the content, the Site’s capabilities, its limitations or the suitability of the Site and the content for your needs, including in respect of their interruption, temporary or permanent, or the failure to retain and/or the loss of content. The Operator does not undertake that the Site will be available and accessible at all times. The Operator does not undertake that the Site will be uninterrupted, will operate properly or without interruptions, will be secure and error-free, or will be immune from unauthorised access or from damage, malfunctions, faults or failures in hardware, software, or communication lines and systems, whether at the Operator or at any of its suppliers.

4.2 The Operator may close the Site and change, from time to time, its structure, appearance and the availability of the services and content provided on it, without needing to notify you in advance. You will have no claim, suit or demand against the Operator in connection with this or in connection with malfunctions on the Site resulting from such changes.

4.3 The materials on the Site are general only and are intended to provide marketing information about the Operator, its activity and/or its services. They do not constitute a representation, an undertaking, a binding offer, professional advice or a substitute for exercising independent judgement and obtaining professional advice, where required.

4.4 The content of the Site is general information only and does not constitute legal advice or a substitute for it. It should not be relied on in making a decision or taking action in any particular matter, and every matter requires an individual review of its circumstances by an attorney. Use of the Site, including contacting the Operator through it, does not create an attorney-client relationship.

4.5 If an error has occurred and/or if you have been harmed by any content on the Site, please contact us using the contact details published on the Site, and we will make reasonable efforts to address your request.

4.6 The Site includes links to websites and services of third parties, such as WhatsApp, Google Maps, Facebook and LinkedIn. Accessing and using them is subject to the terms of use and privacy policies of their operators, and not to these Terms of Use. The Operator does not control these services and is not responsible for their content, their availability or the way in which they collect and use information.

5. Limitation of liability

The Operator and/or anyone on its behalf are not liable to you and/or to any other person for any damage whatsoever, including indirect damage, distress or inconvenience, arising from or connected with the use of the Site, the content and the services, including in connection with their provision, reliance on them, the inability to use them or any action the Operator took or refrained from taking, even if the Operator or its agents or representatives knew or were informed of the possibility of such damage.

6. Intellectual property

6.1 All information appearing on the Site is the exclusive property of the Operator or of a third party that has permitted the Operator to use it. The content and services provided through the Site shall not be regarded as granting any licence or any rights in the intellectual property of the Operator or of third parties. The pages of the Site may not be copied or published, and no use may be made of them or of the information or content in them, including commercial use, without the Operator’s express prior written consent. Copyright in everything relating to the Site, including the design of the Site and any content or component unique to the Site, is reserved to the Operator or anyone on its behalf. In addition, no part of the Site may be altered, copied, distributed, broadcast, publicly displayed, publicly performed, reproduced, modified, adapted, published, sold, rented out or transferred to a third party, directly or indirectly, in any way or by any means, including by electronic, mechanical, optical, photographic or recording means, without the Operator’s prior written consent.

7. General

7.1 The Operator may terminate your use of the Site if you fail to comply with any of these Terms of Use, without derogating from any other remedy available to the Operator under any law.

7.2 The Operator reserves the right, at its sole discretion, to change these terms at any time. Such a change will take effect seven (7) days after the amended terms are published on the Site, and your continued use of the Site after that means that you accept these changes.

7.3 You undertake to indemnify the Operator, its employees or anyone on its behalf for any damage, loss, loss of profit, payment or expense they incur, including attorneys’ fees and legal costs, as a result of a breach of these Terms of Use.

7.4 These Terms of Use are governed solely by the laws of the State of Israel. The exclusive place of jurisdiction for any matter relating to these Terms of Use and to use of the Site shall be the competent courts in the Tel Aviv-Jaffa district.
