This privacy policy (the “Privacy Policy”) sets out how the operator of the website BenAvi-Law.com (the “Site Operator”, “we”, “us” or “our”) collects, uses, stores and shares personal information in connection with the use of the website and the services offered on it (together, the “Site”).

1. Introduction

This Privacy Policy describes how personal information collected through the use of the Site is handled, and the choices available to users regarding the collection and use of that information.

2. Terms of Use

This Privacy Policy forms part of the Site’s Terms of Use. For more information about the Terms of Use, please see the Terms of Use published at BenAvi-Law.com/en/terms. Terms not defined in this Privacy Policy have the meaning given to them in the Terms of Use.

3. Consent and changes to the Privacy Policy

You are not required by law to provide us with personal information, and you provide it of your own free will and with your consent, except where the law requires it to be provided, for example for identification, reporting to the authorities or registration of a transaction. Without the required information, we may be unable to respond to your inquiry or handle your matter. Use of the Site constitutes consent to the terms of this Privacy Policy, including the collection, processing and sharing of personal information as set out in it. If you do not agree to the Privacy Policy, please refrain from using the Site. We may update this Privacy Policy from time to time. Your continued use of the Site after such an update is published will constitute consent to the updated Privacy Policy.

4. Privacy of minors

The Site is not intended for minors under the age of 18, and we do not intend to knowingly collect personal information from such minors. If you become aware that personal information of a minor has been provided to us without the consent of an authorised person as required by law, please contact us at Or@BenAvi-Law.com, and we will review the request and handle the information in accordance with the law.

5. Types of personal information collected and how it is collected

5.1 Contacting us. When you choose to contact us through the contact form, email, phone, WhatsApp or a message on social media, we may collect information you provide to us, such as your name, email address, phone number, company name, and the subject and content of your inquiry, including sensitive details or details you send on your own initiative as part of the inquiry. The contact form does not store your details on the Site and does not send them to the Site’s servers: clicking “Send” opens the email application on your device with a ready-made message, and the inquiry reaches us as an ordinary email, only after you choose to send it.

5.2 Mailings and updates. If you choose to receive information, updates or marketing content from us, we may collect your email address and other details you provide for that purpose. You may withdraw your consent to receiving marketing mailings at any time, as set out below.

5.3 Technical information. When you browse the Site, the Site’s hosting provider automatically records limited technical information, as is customary for any website: IP address, browser type and operating system, the address of the requested page, and the date and time of the request. This information is used solely for the security of the Site, to prevent misuse and for its proper operation. We do not use it for advertising, segmentation or profiling of visitors, and we do not combine it with other information.

5.4 Cookies, analytics and local storage. The Site does not use cookies, analytics tools, pixels or other tracking technologies, and does not share browsing information with third parties for advertising purposes. The Site stores a single technical item in your browser (localStorage): the date on which the opening animation was shown, so that it is not shown more than once a day. This item contains no personal information, is stored on your device only, and is not sent to us or to any third party. You can delete it at any time through your browser settings, and doing so does not affect how the Site works. If we decide in the future to use cookies or analytics tools, we will update this policy and ask for your consent before activating them.

5.5 Information in the course of providing legal services. When you, or an entity you are connected with, receive legal services from us, we collect the information needed to handle the matter, such as identification details (name, ID number or company number, address) and copies of identity documents, contact details, documents and information about the property and the transaction, financial information required for the transaction, for financing or for registering collateral, such as bank account details and loan details, information required for the taxation of the transaction, details required for billing and issuing receipts, and correspondence.

5.6 Information received from third parties. In the course of our work we may receive personal information that does not come directly from you, including: from financing and lending entities we advise (details of borrowers, guarantors and holders of rights in the encumbered property); from mortgage advisers and other professionals who refer clients to us (contact details and initial details of the matter, which you gave them for the purpose of the referral); from the other party to a transaction or their counsel; from professionals involved in a transaction, such as brokers and appraisers; and from public registries, such as the Land Registry, the Registrar of Companies and the Registrar of Pledges.

5.7 Meetings and professional events. We may receive contact details that you give us on your own initiative at meetings, conferences or professional events, for example by way of a business card. These details are used to continue our business relationship with you, and will not be used to send you advertising except with your consent.

6. The purposes for which we collect information

We may use personal information we have collected, as set out above, for the following purposes:

6.1 To respond to inquiries, contact users and provide information they have requested.

6.2 To provide legal services, including drafting and reviewing documents, carrying out transactions and registering collateral, including with the assistance of artificial intelligence tools, as set out in the section “How we share personal information” below.

6.3 To send updates, professional information, offers and marketing content, subject to obtaining consent as required by law.

6.4 To operate, maintain, improve and develop the Site and the services offered on it.

6.5 For information security, fraud prevention, handling malfunctions and compliance with the law.

7. How we share personal information

We may share personal information with third parties only in the following cases, and to the extent required for the purposes for which the information was collected or in accordance with the law:

7.1 With service providers acting on our behalf who assist in operating the Site, storing information, managing communication systems, artificial intelligence services, information security or providing other services in connection with the Site and the office’s activity, subject to appropriate undertakings of confidentiality and information security.

7.2 Use of artificial intelligence tools. We may use artificial intelligence (AI) tools in the course of providing legal services, such as in drafting, reviewing and summarising documents, including by processing personal information relating to the matter being handled. We do so only through providers acting for us under commercial terms, and subject to contractual undertakings (a DPA) under which the information is used solely to provide the service to us, is not used to train the provider’s models, and is kept confidential with appropriate security measures. We do not enter clients’ personal information into AI tools operating under consumer terms of use. AI tools do not replace the professional judgement of the attorney: every output is reviewed by an attorney before it is used, and no decisions are made about you based solely on automated processing. A client who does not wish information relating to them to be processed with AI tools may notify us, and we will respect their request.

7.3 If we believe in good faith that access to, or use, retention or disclosure of, the information is reasonably necessary in order to: (1) comply with a legal obligation, court order, legal process or a demand by a competent authority; (2) detect, prevent or address fraud, security or technical issues; or (3) protect our rights, property or safety, or the rights, property and safety of users or of the public.

7.4 Personal information may be processed or stored through service providers located outside Israel. In such a case, we will act in accordance with the applicable law and take reasonable measures to protect the information.

7.5 Merger or sale. In the event of a merger, acquisition, sale of assets, reorganisation or similar transaction, personal information may be transferred to the relevant party as part of the transaction, subject to the law.

8. Unsubscribing from mailings

You may ask to stop receiving marketing messages from us by using the unsubscribe link included in such messages or by writing to Or@BenAvi-Law.com. Even after an unsubscribe request, we may send operational or service messages required to respond to your inquiry or to comply with the law.

9. Information security

We take reasonable and customary measures to protect the personal information held in our systems against unauthorised access, use, alteration or disclosure. However, we cannot guarantee the absolute security of the information or of communication systems.

10. Your rights and contacting us

Subject to the law, you may contact us to request access to personal information about you that we hold, and to request the correction or deletion of information that is not accurate, complete, clear or up to date.
